1. Purpose of the lease, conclusion of the contract and terms of payment

The apartment may be used exclusively for spending private vacations. Any commercial or other use is excluded. We recommend taking out liability insurance in case of damage to the apartment and its furnishings.

The contract between the tenant and the landlord is concluded when the tenant accepts the offer. In the case of bookings via the Internet, the contract is concluded by clicking on the “Book for a fee” button. The tenant will receive confirmation of the booking by e-mail. The contract is deemed to have been concluded as soon as the first payment has been received by the landlord and the booking confirmation has been sent. Payment by credit card may be subject to transaction fees / foreign charges. We recommend bank transfer. The data will be delivered by the lessor in due time.

  1. Prices

Prices depend on the state of renovation of the apartment and the season in which the apartment is booked. The in the booking system of www.vulperaresort.ch include the mandatory additional costs for the final cleaning. The cost of final cleaning depends on the size of the apartment. The one-time cleaning costs per stay are:

When booking the apartment can be added other services. The prices for this are shown separately.

The visitor’s tax of CHF 5.00 per person per day is also mandatory. The price of the spa tax includes free use of public transport in the Scuol region. To issue guest cards, we need the address with zip code and town, surname, first name and e-mail address of each individual guest. Children under 12 years do not have to pay tourist tax.

  1. Service charges

Ancillary costs (such as electricity, gas, heating, etc.) are included in the rental price unless they are expressly stated in the reservation confirmation.

Additional costs / services not included in the rental price such as final cleaning, bed linen and bath towels, etc. as well as the local tourist tax will be paid on site at the latest on departure.

  1. Terms of payment

100% of the rental amount must be paid no later than 28 days before the start of the rental period. We ask you to transfer the amount without visitor’s tax to the following bank account at the Graubündner Kantonalbank:

When paying by credit card, a fee of 3% of the payment amount will be charged.

  1. Cancellation conditions

Up to 29 days before arrival we charge an administration fee of 10% of the rental price.

  • 28 to 0 days prior to arrival, no-show or early departure: 100% of the rental price as per deposit to be forwarded to your cancellation insurance.
  • We recommend that you take out cancellation insurance if you do not already have any.
  1. Handover of the rental property, complaints (check-in from 4 p.m.)

The rental object is handed over to the tenant in a clean condition. If there are any defects or the inventory is incomplete at the time of handover, the Lessee shall immediately notify the Lessor thereof. Otherwise, the rental object is considered to be handed over in perfect condition.

Should the tenant take over the apartment late or not at all, the entire rental price remains owed. The tenant himself is responsible for a timely arrival. Any obstacles to arrival (such as traffic congestion, closed roads, etc.) are his responsibility.

  1. Careful use
  • The tenant undertakes to use the rented property with care, to comply with the house rules and to show consideration towards the other residents and neighbors. In the event of any damage, etc., the landlord must be informed immediately.
  • The rental property may only be occupied by the maximum number of persons stated in the reservation confirmation.
  • The tenant is responsible for and vouches for the fact that the housemates including the guests comply with the obligations of this contract/reservation confirmation.
  • Pets are allowed only in selected apartments and only by appointment. These are listed separately in the reservation confirmation.
  • Smoking is not allowed in any of the apartments.
  • If the tenant, roommates or their guests violate the obligations of careful use in a grossly negligent manner or if the apartment is occupied by more than the contractually agreed number of people, the landlord may terminate the contract without notice and compensation. In this case, the rent remains due. We reserve the right to make subsequent claims and claims for damages.
  • Subletting is not allowed.
  1. Return of the rental property (check-out by 10.00 a.m.)

The rented property must be returned on time and in proper condition, including inventory.
Check-in on the day of arrival from 4.00 pm, check-out on the day of departure until 10.00 am. Any remaining amounts must be settled by 5 p.m. on the evening before the day of departure at the latest.

Even if the final cleaning has been agreed additionally, the cleaning of the kitchen equipment, including crockery and cutlery is nevertheless the responsibility of the tenant. The beds must be stripped and the bed linen and towels deposited in a room.

The tenant is liable for damages and missing inventory. We recommend taking out liability insurance in case of damage to the apartment.

  1. Withdrawal from the contract

If the tenant is unable to take the contractually agreed vacation, he must notify the landlord in good time. Within 28 days before arrival the full rent will be charged.
An administration fee of 10% of the rental price will be charged up to 29 days before arrival.

If the tenant does not use the full, agreed vacation period, the rent is still owed in full.

  1. Waste disposal

For the separate disposal of household waste, public collection points are available at the Postbus turnaround area or in Scuol at Crüzer Abfallentsorgung.

For the disposal of refuse, only the official yellow fee bags of the Scuol Waste Association may be used. These can be obtained for a fee at the reception or in various stores (Coop, Volg, Denner).

All waste must be disposed of by the tenant upon departure.

  1. Force majeure etc.

If force majeure (environmental disasters, force of nature, official measures, etc.), unforeseeable or unavoidable events prevent the rental or its continuation, the lessor is entitled, but not obliged, to offer the lessee an equivalent substitute object to the exclusion of claims for compensation. If the service cannot be provided or cannot be provided in full, the amount paid will be refunded on a pro rata basis to the exclusion of any further claims.

  1. Liability

The lessor is responsible for a proper reservation and fulfillment of the contract in accordance with the contract. The liability of the lessor is excluded to the extent permitted by law. In the case of damage other than personal injury, liability is limited to twice the amount of the rental fee, except in cases of gross negligence or willful misconduct.

Liability is excluded for failures on the part of the tenant or co-user, including their guests, unforeseeable or unavoidable failures of third parties, force majeure or events which the owner, landlord, agent or other persons called in by the landlord could not foresee or avert despite due care.

The tenant is liable for all damages caused by him or co-users, including their guests. Fault is presumed.

  1. Landlord, owner, data protection

The lessor of the leased property is not the same as its owner. The owner will be informed by the landlord about the content of the reservation confirmation and the invoice.

The Lessor reserves the right, in order to pursue legitimate interests or in case of suspicion of a criminal offense, to transmit the data of the Lessee, co-user or their guests to the competent authorities or to instruct third parties to enforce its rights.

  1. Applicable law, place of jurisdiction
  • Swiss law is applicable.
  • The place of the rental object is agreed as the exclusive place of jurisdiction.
